Institutional setting

  • In December 2011, the Government of Montenegro issued the Decree on organization and method of work of state administration (Official gazette No 5/12, Montenegrin version).
  • Ministry of finance is responsible for supervising legality and completeness of administrative act of Real Estate Administration (REA). REA’s responsibilities are the same as in previous period.
  • Ministry of finance has obligation to harmonize acts on internal organization and systematization. REA will inform the project team about these details when they receive the information.
Land administration
 
Law on amendments to the Law on state survey and real estate cadastre (official gazette No 29/07 and official gazette No 32/11) was accepted in 2011 (www.uzn.me, Montenegrin and English version).
Law on amendments to the Law on spatial planning and construction of structures (official gazette No 51/08, 40/10 and 34/11) was passed in 2011 (www.uzn.me, Montenegrin version).
 
Spatial data infrastructure (SDI)
 
Law on amendments to the Law on state survey and real estate cadastre introduces areas that expand previous Law’s coverage, such as National geospatial data infrastructure, geodetic works in engineering-technical areas, defining spatial referent system and web services.
This Law defines the terms National geospatial data infrastructure (NSDI) and metadata; it also defines funding, maintenance and use of NSDI geodata, NSDI content, databases and services of geo-data, NSDI Geoportal, as well as NSDI Council and it's competences.
 
REA started an initiative for NSDI Council establishment. It also carried out draft decision on defining NSDI subjects and forwarded it to the Ministry of finance. Also, REA is drafting the Agreement on accession to NSDI, which is to be signed by the NSDI Council and by future subjects.

Relevant other projects
 
Real estate administration won many achievements in previous period, taking into consideration complexity and the scope of the work in its competency. The administration performs activities according to the Midterm program of works on survey and design of real estate cadastre for period 2008-2013 (accepted by Montenegrin Government) and mainly works on: establishment of real estate cadastre, production of digital topographic map, DTM and orthophoto, web services updates, branch offices renovation, construction of new premises for REA headquarters and for Podgorica branch office, specification of normative documents and international cooperation.
 
Activities on establishing real estate cadastre for about 500.000 ha of the territory, which is part of census cadastre, are currently being implemented. Establishing real estate cadastre provides data on real estate and rights on them. At the same time digital ortopohoto plans are being created with aerial view of the terrain, which are needed as a basic geometric base for drafting spatial planning technical documentation. Once real estate cadastre alphanumeric and graphical data are entered into force, they will be available on the internet.
 
Real estate administration in the previous period worked on designing digital topographic map at scale 1:25.000 in cooperation with the International Cooperation Agency of Japan (JICA).
Based on donation of the Japanese Government in 2007, production of digital topographic map at scale 1:25.000 for 70% of the territory of Montenegro (93 map sheets) was started, in cooperation with REA’s employees. For the sake of this map-making enterprise, aerial shooting of the whole territory of the Republic of Montenegro was done in scales of 1:35.000 to 1:40.000. The work for remaining 30% will be realized by Real estate administration in the upcoming period.
 
REA operates the permanent GNSS station network called MONTEPOS, and during 2011 it completed the project of creating the transformation parameters.
 
On REA’s web pages the following data are implemented and maintained:
  • ownership structure as well as any restrictions, with possibility of preview by personal identification number, number of title of deed or possession deed,number of parcel located in cadastral unit,
  • interactive digital map,
  • ortophoto for entire Montenegrin territory (date of scanning 2007. pixel size 0,5 m),
  • digital map of Montenegro scale 1:25.000 for 70% of territory
  • thematic data including road network, rail network, watercourses, inhabitant places, objects, digital terrain model, relief, administrative boundaries, cadastral unit boundaries,
  • MontePos permanent station network data.
Geoportal of Real Estate Administration (www.geoportaluzn.me) is implemented with view, download, transformation and invoke services. Currently available data are: orthopohoto scans for entire territory of Montenegro, ortophoto from different time of scanning for various locations, map at scale 1:25.000, consolidated alphanumeric and graphical databases for cadastral units that were upgraded to real estate cadastre, and are encompassed by surveys from 2007 to 2010.
 
During 2012 it is planned to make all graphical data from real estate register available via internet, while alphanumeric data are available since 2007. For all interested institutions a link is provided for data available on the above mentioned internet page.
 
Real estate administration continues to maintain good international cooperation with partner institutions in Europe, thereby proving its good relations and readiness to exchange experience and to learn.
 
Real estate administration achieved successful cooperation with  Government of Norway and Statens kartverk (SK) - Norwegian Mapping  Authority in realization of the Project Geographic information for development and EU integration. This Project encompasses following activities:
  • Orthopohoto scanning for entire territory of Montenegro at 20 cm resolution and drafting digital terrain model (1 point per sqm), with expected finalization  on 01.08.2011, after which the data will be available via internet
  • Upgrading electronic services
  • Establishing capacity for spatial data national infrastructure development
  • Active partnership in EU inspire program.
Real estate administration realizes World Bank’s loan from 2009 under the Land administration and management project (LAMP). Within LAMP there are 3 ongoing projects regarding creation of real estate cadastre for the part of Montenegro not yet surveyed. In 2012 a new project will start which considers IT system modernization. By mentioned projects area of 240.000 ha will be covered.
 
In order to upgrade the level of services and products Real estate administration provides, REA management decided to start the process of renovating branch offices throughout the entire country. This renovation is performed in compliance with European standards and practice, from REA budget and LAMP Project (mainly in northern municipalities).
 
Real estate administration started building a new business premises in July 2011 financed by LAMP Project and Montenegrin budget, and will be built in 18 months. The new building of 8.600 m2 will provide fusion of all REA’s functions, in order to ensure higher security of holder of rights and our customers.

Further relevant institutions
 
By the law on state survey and real estate cadastre and the decree on organization and method of work of state administration REA was recognized as the institution responsible for NSDI. However, there are other institutions that in their responsibilities deal with, or produce spatial data.
